Terms of Service

These Terms of Service ("Terms") govern your access to and use of Selectic, Inc.'s ("Best Memories", "we", "us") AI photo booth and event-gallery service, including the web app at bestmemories.ai, the iOS app (the "Booth App"), the Lightroom Classic plugin, the wifi-direct camera upload worker, public guest galleries, and any related APIs (collectively, the "Service").

1. Acceptance

By creating an account, downloading the Booth App, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

The Service uses a tiered age model:

  • Photographer / paid account holders. You must be at least 18 years old to create a Best Memories photographer account, manage events, or purchase a subscription or balance top-up. By creating an account you represent that you are 18+ and have the legal capacity to enter into these Terms.
  • iOS app users in volunteer mode. You must be at least 13 years old to download and use the iOS Booth App. Users between 13 and 17 represent that they have a parent or legal guardian's permission to use the app.
  • Booth guests. Guests photographed as subjects at an event may be of any age. Where a guest is under 13, the photographer and event organizer are responsible for obtaining parental or legal-guardian consent before the guest is photographed and before any photo of the guest is sent to our AI styling pipeline.

3. What the Service does

Best Memories is software-as-a-service for photographers, planners, and event hosts:

  • The iPad Booth App runs at events as an AI photo booth. Guests select an AI style, the app captures a burst, and a styled gallery is delivered to the guest's phone (SMS, email, or QR scan).
  • The iPhone Volunteer Mode lets a participant at an event shoot the night on their phone; photos are AI-styled and delivered to the gallery.
  • The photographer dashboard manages events, billing, branding, and the public photographer profile page.
  • The Lightroom Classic plugin and the wifi-direct camera worker let pro photographers stream captures into the AI pipeline from their existing kit.
  • The AI styling pipeline applies pre-curated or photographer-defined style packs to original photos via third-party AI image-generation providers.

4. Your account

You are responsible for keeping your password, kiosk tokens, and API keys confidential, and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree not to: (a) use the Service for illegal, harassing, abusive, or harmful purposes; (b) capture or distribute photos of minors without parental consent; (c) attempt to extract, reverse-engineer, or copy our AI models, prompts, or underlying technology; (d) attempt to circumvent content safety filters or rate limits; (e) create multiple accounts to evade bans; (f) use automated tools, bots, or scripts to access the Service beyond officially documented APIs; (g) submit content that infringes another party's intellectual property; or (h) impersonate another person.

Children at events. The Service is a general-audience event-photography product and is not designed or marketed for children under 13. You may not rebrand or deploy the Service as a child-directed product (for example, a kids-themed booth UI, an event whose primary audience is under 13, or marketing aimed at children). At mixed-age events where minors are present (weddings, family receptions, corporate gatherings), you are responsible for obtaining parental or legal-guardian consent before a child under 13 is photographed or interacts with the booth as a primary subject.

6. Photos and AI styling

You retain ownership of the original photos you capture or upload. By submitting a photo to the Service, you grant Best Memories a non-exclusive, worldwide license to store, process, transmit to AI providers, generate styled outputs, and deliver galleries on your behalf — solely to operate the Service. We do not use your photos to train our own AI models, and we do not license your photos to AI providers for training (see Privacy Policy Section 3). Styled outputs are yours, subject to these Terms and the underlying license terms of the AI provider that generated them.

Guests at events captured by the booth own the rights to their own likeness. The event organizer and the photographer running the booth are responsible for obtaining any consent needed for guest photography, including parental consent for minors and any model releases. Best Memories acts as a processor on the photographer's instructions and is not the controller of guest likeness rights.

Face search and biometric data.Shared event galleries include an optional "find my photos" feature that matches a guest's selfie against the event's photos using face signatures. This feature is off by default. If you enable it, you are responsible for providing any notice and obtaining any consent required by applicable biometric-privacy laws (such as Illinois' BIPA) before your guests' faces are processed for matching, and you represent that you have done so. See our Privacy Policy (Section 3) for how face matching works and how the data is retained and deleted.

7. AI-generated content disclaimer

AI-styled outputs are generated by third-party machine-learning models. They may contain visual artifacts, identity drift, or stylization the user did not anticipate. Best Memories provides no warranty that any specific styled output will be free of artifacts, suitable for any specific purpose, or identical across runs. AI styling is intended for personal, editorial-style, and event-souvenir use; it is not certified for identity documents, legal records, or any official purpose.

8. Subscriptions, free trial, and prepaid balance

We offer a free Starter plan, a Pro plan billed monthly, and a Studio plan (currently waitlist-only). Pro starts with a 7-day free trial; we collect your card at checkout and the first monthly charge (Pro: $49) fires after the trial ends unless you cancel during the trial. Pro auto-renews monthly until canceled. Cancellation is effective at the end of the then-current billing period; we do not pro-rate mid-period cancellations.

The Starter plan uses a prepaid balance model: you top up your balance from your dashboard and each AI styling session debits the balance at the published rate. Top-ups are non-refundable except where required by law. Unused balance does not expire while your account is active.

You can cancel, change plans, view invoices, or update your card at any time from your photographer dashboard at bestmemories.ai/billing.

9. Payment processing and Apple App Store

We do not use Apple In-App Purchase.All paid subscriptions, prepaid balance top-ups, and other paid Service features are billed through Stripe via web checkout — either directly at bestmemories.ai/billing or via a Safari View Controller opened from the Booth App. Best Memories provides services for real-world events (App Store Review Guideline 3.1.3(e)), so subscriptions are not eligible for and do not use Apple's In-App Purchase system.

How to cancel: manage cancellation, refunds, payment-method changes, and tax invoices at bestmemories.ai/billing — not in your Apple ID Subscriptions screen. Apple does not process or refund Best Memories payments.

10. Guest galleries and SMS / email delivery

Gallery delivery via SMS is opt-in at the booth: the guest types their own phone number(s) on the iPad and consents to receive the gallery link. Standard message and data rates from the guest's carrier may apply. Guests may reply STOP to unsubscribe from the sender phone number; we will not send further messages to that number. Gallery delivery via email requires the guest to provide an email address at the booth.

11. Intellectual property

The Service — including the web app, the Booth App, the Lightroom plugin, the FTP worker, the AI prompts, the style packs, the gallery templates, the brand, and the code — is owned by Selectic, Inc. and protected by U.S. and international copyright, trademark, and other laws. Nothing in these Terms transfers ownership of the Service to you. You may not redistribute, sublicense, sell, or create a competing service from the Service.

12. Account termination and deletion

Self-serve deletion. You may delete your account at any time. Sign in at bestmemories.ai, open Account settings (tap your email in the dashboard header, or go directly to bestmemories.ai/account), scroll to the Delete account card, tap Delete my account, and type DELETE to confirm. The account is closed immediately, you are signed out on every device, your public profile page is taken offline, and the original email address is freed.

By email. If you can't sign in, email legal@bestmemories.ai from the account email address — we verify the request and process the deletion within 7 business days.

Active subscriptions. Deleting your account does not automatically cancel an active Stripe subscription. Cancel first from the billing portal (linked at bestmemories.ai/billing), then delete the account, otherwise the subscription will keep renewing on Stripe. The Account settings page warns you about an active subscription before you confirm.

Data after closure. Closure of your account revokes all access (signed out on every device, API keys and refresh tokens invalidated, public profile taken offline). Your events, booth sessions, and photos are then queued for permanent removal under the retention schedule in the Privacy Policy (Section 8).

Suspension / termination by us. We may suspend or terminate your access if you violate these Terms, harm other users, or place an undue load on our infrastructure.

13. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Selectic, Inc., its officers, employees, and contractors are not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or service interruptions, arising from your use of the Service. Our total aggregate liability to you for any claim under these Terms is limited to the amount you paid to Best Memories in the twelve months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify and hold Selectic, Inc. harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your use of the Service in violation of these Terms, (b) photos you submit infringing a third party's rights, (c) your failure to obtain required guest or model consent at an event, or (d) any taxes owed on your event revenue.

15. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising from or relating to the Service or these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

16. Changes

We may update these Terms. Material changes will be announced via email to photographer account holders and posted on this page with an updated "Last updated" date. Continued use of the Service after a change constitutes acceptance.
